PLEASE NOTE THAT THIS IS NOT A REQUEST FOR QUOTES OR PROPOSALS, NO SOLICITATION EXISTS AT THIS TIME.



The U.S. Department of Agriculture (USDA), Animal Plant Health Inspection Services (APHIS), Plant Protection and Quarantine (PPQ), Aircraft & Equipment Operations (AEO) Facility in Edinburg, TX has approved the purchase of 80,000 gallons of Aviation Fuel 100 Low Lead under a 3 year Basic Ordering Agreement (BOA) in Accordance with FAR 16.703 Basic ordering agreements. AEO can only accept the Dye Version of the Aviation Fuel 100 Low Lead, (Blue Dye).





The Basic Ordering Agreement will be awarded to Pico Propane Operating, LLC



SAM UEI GWBEEQ4256G8/ CAGE 7NV35 under Small Business Vendor: NAICS Code – 324110 Petroleum Refineries



Small Business Size – 1,500 Employees





All cost to include but not limit to: overhead, general and administrative, profit, insurance, and transportation. The Period of Performance is for twelve months and two possible twelve month option periods.





Delivery will be by Tank Wagon (TW), 3200 gallons quantities at 5 – 6 week intervals





The Ordering Agreement is needed in order to guarantee the AEO Moore Air Base will receive supplies consistently and on time with orders for purchases fulfilled immediately when requested.





SPECIAL REQUIREMENTS



(Accreditation or Certifications needed to perform services)



Vendor must present current proof of the following Certifications



1. U.S. Department of Transportation Federal Hazmat Registration for pipeline and hazardous materials



2. Texas Fuel License



3. Texas Department of Agriculture Fuel Quality Distributor License







The statutory authority permitting other than full and open competition.



41 U.S.C § 1901 - Simplified Acquisition Procedures up to $7.5 million, as authorized by FAR 13.500(a) and implemented by FAR 13.501(a).



In accordance with procedures for purchases exceeding the simplified acquisition threshold. The requirements at 13.501(a) apply to sole-source acquisitions of commercial products and commercial services conducted pursuant to subpart 13.5.



Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available. The additional administrative cost for further market research and time for formal competitive solicitation procedures are not deemed warranted and would only cause substantial duplication of cost to the Government that is not expected to be recovered through competition, and unacceptable delays in fulfilling the agency’s requirements.



Per Statutory Requirements:




  • The DLA Department of Energy was contacted regarding this new Fuel Contract or agreement to ensure that USDA energy acquisitions meet the requirements of FAR Section 8.002 and 41 CFR 101-26.602-3.






  • On 07/20/2022 Request for Continuation to purchase locally was sent to DLA Department of Energy






  • On 07/21/2022 Email Received: Case CS0412435 was opened on behalf of USDA/APHIS/PPQ/AEO to determine continuation to purchase locally or whether DLA would provide a contract per 41 CFR 101-26.602-3.






  • On 01/03/2023 Continuation was granted since DLA does not provide the specific fuel type (Aviation Fuel 100 Low Lead, Blue Dye) and DLA unable to provide any cost savings at this time.

This Notice of Intent is not a request for competitive proposals. No solicitation documents are available and telephone requests will not be honored. However, if a firm believes it can meet the requirements it must furnish information about its products and services and special requirements, as well as three (3) references from other customers in the Hidalgo County, TX using who are purchasing Aviation Fuel 100 Low Lead (Blue Dye) to the Contracting Officer by 8:00 am (MST) on the closing date of this notice. Supporting evidence must be furnished in sufficient specifications and detail to demonstrate the ability to comply with the above requirement. The North American Industry Classification System (NAICS) code for this acquisition is 324110 Petroleum Refineries, and the Small business size standard is 1,500 Employees
