• Travel cost is included within the service plan fee.


• The contractor must inform the point of contact at USDA/APHIS/PPQ S & T, on potential dates for installation or maintenance. The POC will negotiate the final date and time of the visit. The POC will then inform the facility Manager at Moore Air Base located at 22675 N. Moorefield Road, 78539 Edinburg, Texas of the upcoming scheduled visit. The facility manager will inform the security guards at the entrance of the base of the upcoming visitor and date or dates of the visit. The contractor (visitor) will be advised prior to the visit to bring a photo ID for entrance onto the facility. At that time, the POC will be reached and will meet with the contractor at the entrance to Building 6414. The POC will escort the contractor to the Microscopy Lab located inside bldg. 6414, and this is the location of the Hitachi Tabletop Scanning Electron Microscope.

In accordance with Federal Acquisition ( FAR) 13.106-1 (2) the Government will award a purchase order resulting from this solicitation to the responsible Quote conforming to the solicitation that will be the “Best Value” and most advantageous to the Government. In accordance with FAR 13.106-2 (b)(3); Product Offered, price, and delivery are the factors to be considered.

Brand Name Justification:

In accordance with FAR 13.106-1(b)(1)(i) and FAR 13.106-3(b)(3)(i). )For acquisitions greater than the micro-purchase threshold but less than the Simplified Acquisition Threshold (SAT) the Contracting Officer may solicit from one source only if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, etc.).

USDA APHIS PPQ Science and Technology already owns a Tabletop SEM. They wish to purchase an accessory for use with the Hitachi Tabletop SEM. The add-on accessory they want to purchase is the Oxford Aztec Energy Dispersive Spectrometer (EDS) with TruMAP.

Any pursuit of comparable products at this time would result in substantial duplication of cost to the Government due to non compatibility of components and methods currently in use.

Pricing:

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(xiii) Additional Contract Requirements or Warranty

Warranty

Implied Warranty - The Government’s post award rights contained in 52.212-4 are the implied warranty of merchantability, the implied warranty of fitness for particular purpose and the remedies contained in the acceptance paragraph.

Additional Warranty - : Explain all details of the warranty. If an extended warranty is available explain details of extended warranty including price and availability after initial warranty expires. The Quoter shall extend to the Government the full coverage of any standard commercial warranty normally Quoted in a similar commercial sale, provided such warranty is available at no additional cost to the Government. Acceptance of the standard commercial warranty does not waive the Government's rights under the Inspection clause nor does it limit the Government's right with regard to the other terms and conditions of this contract. In the event of a conflict, the terms and conditions of the contract shall take precedence over the standard commercial warranty. The contractor shall provide a copy of its standard commercial warranty (if applicable) with this response.

(xiv) There is no Defense Priority Allocation for this requirement.
