Question
I recall in our prior meeting there was a requirement for a teacher to become re-certified after experiencing a mental health crisis/traumatic stress by in person physician.

- Is this still a requirement?

-On top of this will there be in person physician requirements?
Answer
In-person sessions are always best but not necessary. The Human Resources department only needs a document from a mental health professional (Psychologist) that the employee is stable and does not pose a threat to himself/herself or others and is ready to return to work status.

- Venue
It is understood and agreed by both the successful bidder and the DISTRICT that venue for any litigation from this contract shall lie in Webb County, Texas.

-Is this a deal breaker if MDLIVE does not agree to facilitate litigation out of Webb County, TX?
Answer The District will review any deviations submitted but I can tell you from past experience that our attorney does not like us to accept any deviations to this term/attribute.

Question
- Termination Without a Cause

The DISTRICT in accordance with this provision may terminate the performance under this order in whole or in part. Termination hereunder shall be effected by the delivery to the contractor or a “Notice of Termination” specifying the extent to which performance of work under the order in terminated and the date upon which such termination becomes effective.

-Is termination without a cause a must have?
Answer We will review any deviations submitted and the reasons for the deviation. All deviations the District agrees to will be done in writing during the negotiation evaluation process.
