Notes
Intent: It is the intent of these specifications to award an annual contract for the purchase of new or Remanufactured Cummins engine parts, Cummins Fleetguard and Cummins Onan parts for the City of Irving’s Fleet on an “as needed” basis to an Authorized Cummins parts distributor.


Any questions or requests for clarification should be submitted under the questions tab in this online solicitation. The questions will be shared with the department after the end of the cut-off date/time and the responses will be posted as soon as they are received from the department. If the responses necessitate a significant change to the specifications, an addendum will be issued


The City of Irving strongly encourages bidders to submit their response to this bid electronically. Please call the individual listed on the bid if you require assistance with this submittal. Question
Which terms and conditions within this bid package are considered non-negotiable and/or required by law?

If a potential bidder is unable to accept all of your terms and conditions, what is the process to negotiate terms? Is there a proactive process available or must negotiations be initiated upon award?

Who or what department needs to approve any exceptions to the bid package or any terms or conditions contained therein (Board, City Council, Procurement, Legal, Finance, etc.)?
Answer The city's indemnification language is generally non-negotiable. Attachment D-1 - Standard Insurance Requirements notes which coverage limits are negotiable. Any sections of the Standard Terms and Conditions which are not applicable to a specific solicitation do not need to be removed. The city will not negotiate any terms unless/until the vendor is recommended for award. The department who ultimately approves any negotiated/agreed upon exceptions is dependent upon the particular exception and may be any combination of Legal, Risk Management, the department on whose behalf the solicitation was issued, and Purchasing.

If a bidder submits exceptions to the terms and conditions contained within this bid package, will the bidder’s proposal be deemed non-responsive?
Answer Whether or not exceptions will cause a vendor's bid to be deemed non-responsive depends on the number and extent of the exceptions as noted in the revised Bid Acceptance language in Attribute No. 1 as updated by Addendum 1.
